1. Acceptance of Terms

By accessing and using brblly (developed by devlog) ("Service", "Platform", "we", "our", or "us"), you accept and agree to be bound by these Terms of Service. If you do not agree to these Terms, please do not use the Service.

2. Description of Service

brblly provides a platform for businesses to publish theme-powered websites and manage customer communication. The Service enables you to:

• Create and publish websites using brblly themes on subdomains or custom domains
• Manage structured content through collections (services, trips, team, FAQs, and similar)
• Accept form submissions, booking requests, and scheduling through your sites
• Operate a multi-channel agent console for Facebook Messenger, Instagram Direct, and web chat
• Upload and serve media through the built-in media library
• View website analytics on eligible subscription plans
• Invite team members to your organization according to your plan limits
• Subscribe to paid plans processed through our billing partner, Polar

3. User Accounts

3.1 Account Registration

To use the Service, you must create an account with accurate, current, and complete information. You may register with email and password or, where available, sign in with Google. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

3.2 Account Responsibilities

You agree to:

• Provide accurate and truthful information during registration
• Maintain the security of your password and account
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account
• Not share your account credentials with unauthorized third parties
• Ensure invited team members comply with these Terms

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, non-payment, or any other reason at our sole discretion.

4. Pricing and Payment

4.1 Subscription Plans

brblly offers subscription tiers (Basic, Growth, and Pro) with different features, limits, and pricing. Current pricing and plan details are displayed on our pricing page and may be changed with reasonable notice.

4.2 Billing

• Subscription fees are billed in advance through Polar, our payment processor
• Fees are generally non-refundable unless required by applicable law or explicitly stated
• Failed or expired payments may result in suspension of paid features
• Plan limits (websites, storage, team seats, themes, analytics, and channels) are enforced according to your active subscription

4.3 Taxes

Prices may be exclusive of applicable taxes, which will be added to your invoice as required by law.

5. Acceptable Use Policy

5.1 Prohibited Activities

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Send spam, unsolicited messages, or engage in deceptive practices
• Harass, abuse, or harm other users or the public
• Distribute malware, viruses, or malicious code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Reverse engineer or attempt to extract source code except where permitted by law
• Resell or redistribute the Service without authorization
• Use the Service for any illegal or fraudulent purpose
• Violate the terms of service of integrated third-party platforms (Meta/Facebook, Instagram, Google, or others)
• Publish content that infringes intellectual property or privacy rights of others
• Exceed plan limits through circumvention or abuse

5.2 Content Standards

You are responsible for all content you publish through the Service, including website copy, media, collection entries, form fields, and messages sent through connected channels. Content must not be illegal, offensive, defamatory, misleading, or infringing on third-party rights. You are solely responsible for compliance with laws applicable to your business and your end customers.

6. Intellectual Property

6.1 Our Rights

The Service, including platform software, default themes, designs, documentation, and branding, is owned by brblly (developed by devlog) and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the platform except as expressly permitted.

6.2 Your Content

You retain ownership of content you upload or create (text, images, collection data, and similar). By using the Service, you grant us a non-exclusive license to host, store, display, and process your content solely to provide and improve the Service.

6.3 Themes

Theme packages included with your plan are licensed for use within brblly to build your websites. You may not extract, redistribute, or resell theme source files outside the Platform except where explicitly allowed.

7. Data and Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Service, you consent to our data practices as described in that policy. If you collect data from your website visitors or messaging customers, you are responsible for providing appropriate privacy notices and obtaining required consents.

8. Third-Party Integrations

The Service integrates with third-party platforms including Meta (Facebook Messenger and Instagram Direct), Google sign-in, Polar (billing), and Resend (email). Your use of these integrations is subject to the terms and policies of those third parties. We are not responsible for the availability, actions, or policies of third-party services.

9. Service Availability

9.1 Uptime

While we strive to provide reliable service, we do not guarantee uninterrupted availability. The Service may be unavailable due to maintenance, updates, or circumstances beyond our reasonable control.

9.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRBLLY (DEVELOPED BY DEVLOG) SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or data loss
• Actions or inactions of third-party services or messaging platforms
• Unauthorized access to your account or data
• Content published by you or your end customers

Our total liability for any claim related to the Service is limited to the amount you paid us in the twelve (12) months preceding the claim.

11. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12. Indemnification

You agree to indemnify and hold harmless brblly (developed by devlog), its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit or publish through the Service
• Your websites, messaging, or treatment of end-customer data

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of Bosnia and Herzegovina, without regard to conflict of law provisions.

13.2 Arbitration

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in Bosnia and Herzegovina, except where prohibited by law or where either party seeks injunctive relief for intellectual property violations.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.

15. Termination

15.1 By You

You may cancel your subscription and stop using the Service at any time. Cancellation does not entitle you to a refund of prepaid fees except where required by law.

15.2 By Us

We may terminate or suspend your access immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

15.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and data in accordance with our data retention policies and applicable law.

16. General Provisions

16.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and brblly (developed by devlog) regarding the Service.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
